Terms of Service

1. What Afterkey is (and is not)
Afterkey is a software platform that helps home builders, homeowners, and subcontractors coordinate warranty and service work, maintenance schedules, and related records (the “Service”). By creating an account or using the Service you agree to these Terms.
Afterkey is a communication and record-keeping tool only. Afterkey is not a builder, contractor, tradesperson, property manager, insurer, or warranty provider. Afterkey does not perform, supervise, schedule, or guarantee any construction, repair, or maintenance work. All work is performed by builders and subcontractors under their own agreements, licenses, and obligations, to which Afterkey is not a party.
2. Not an emergency service
The Service is not an emergency channel and must never be used to report an emergency. If there is a fire, gas smell, carbon monoxide alarm, downed power line, flooding, or any risk to life or property, call 911 (or your local emergency number) and the responsible builder or contractor directly by phone. Submitting a service request does not guarantee that anyone sees or responds to it within any particular time.
3. Notifications and reminders are a convenience
The Service can send reminders and notifications (email, push, SMS, or in-app), including maintenance reminders and deadline alerts. These are provided as a convenience and are not guaranteed to be delivered, timely, or accurate. Delivery depends on third-party networks and services outside our control. Homeowners remain solely responsible for maintaining their homes; builders and subcontractors remain solely responsible for their own contractual and legal obligations, deadlines, and workmanship — regardless of whether the Service sends, or fails to send, any reminder or notification.
4. Content and records
Information in the Service — including home details, appliance and warranty records, maintenance schedules, contact directories, documents, handoff packets, exports, cost summaries, and reviews — is provided by users (builders, homeowners, subcontractors) or generated from data they enter. Afterkey does not verify this information and makes no representation that it is accurate, complete, or current. Verify critical information (e.g. warranty coverage, contact details, costs) directly with the relevant party before relying on it. Reviews reflect the opinions of their authors, not of Afterkey.
5. Subcontractor profiles and the “Verified” badge
Subcontractors on Afterkey are independent businesses. They are not employees, agents, or partners of Afterkey, and Afterkey does not endorse, recommend, or vouch for any subcontractor. A “Verified” badge means only that license and/or insurance documents were on file and appeared current at the time of review; documents can expire or be revoked at any time. Always confirm a contractor’s current license and insurance status directly before hiring them. Any engagement between a builder or homeowner and a subcontractor is solely between those parties.
6. Payments
Payments made through the Service are processed by Stripe under Stripe’s own terms; Afterkey does not store card details. Membership fees are set by, charged on behalf of, and owed to your builder — Afterkey facilitates the transaction but is not a party to it. Fees, billing start dates, and any refunds are matters between you and your builder. Where these Terms conflict with a separate agreement between you and your builder, that agreement governs your relationship with the builder.
Membership plans, perks, exclusions, and sample content. Membership plan descriptions, included services, exclusions, and any related terms shown in the Service are authored by the builder and form part of the builder’s agreement with the homeowner — not an agreement with Afterkey. Afterkey may provide sample or template language (for example, example perks, exclusions, or agreement text) as a drafting convenience only. Sample content is not legal advice, and Afterkey makes no representation that it is adequate, enforceable, or compliant in any jurisdiction. Each builder is solely responsible for the terms of its own customer and subcontractor agreements, for having them reviewed by its own attorney, and for its own regulatory compliance. Afterkey is not a party to, and has no responsibility for, any agreement between builders, homeowners, or subcontractors.
7. Accounts and acceptable use
You are responsible for your account credentials and for the accuracy of information you enter. You agree not to misuse the Service — including uploading unlawful content, attempting to access other tenants’ data, interfering with the Service’s operation, or using it to send spam. We may suspend or terminate accounts that violate these Terms.
Pricing confidentiality and non-circumvention (subcontractors). If you use the Service as a subcontractor, homeowner contact information shown in the Service is provided solely for scheduling and site access on assigned work. All pricing runs through the Service: the amount you quote or invoice in the Service is between you and the builder, and the homeowner’s price is set by the builder and shown only in the homeowner’s own portal. You agree not to disclose or discuss your pricing with the homeowner, and not to use contact information obtained through the Service to solicit a builder’s customer for work off the platform that originated on it. Builders may treat a violation as grounds to end the relationship, and Afterkey may suspend accounts that misuse contact information obtained through the Service.
8. Service availability
We aim for high availability but the Service is provided without any uptime commitment. It may be unavailable, interrupted, or modified at any time — including due to maintenance, third-party outages (hosting, database, email, SMS, payment providers), or events beyond our control. We may add, change, or remove features at any time.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. AFTERKEY DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT NOTIFICATIONS WILL BE DELIVERED, OR THAT DATA WILL NEVER BE LOST — KEEP YOUR OWN COPIES OF CRITICAL RECORDS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) AFTERKEY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR ANY PROPERTY DAMAGE, PERSONAL INJURY, OR OTHER LOSS ARISING FROM CONSTRUCTION, REPAIR, OR MAINTENANCE WORK (OR THE FAILURE TO PERFORM IT), MISSED OR UNDELIVERED NOTIFICATIONS, INACCURATE USER-PROVIDED INFORMATION, OR YOUR DEALINGS WITH ANY BUILDER, HOMEOWNER, OR SUBCONTRACTOR; AND (B) AFTERKEY’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNTS YOU PAID TO AFTERKEY FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
11. Indemnification
You agree to defend, indemnify, and hold harmless Afterkey and its owners, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, content you submit, work you perform or procure, your violation of these Terms, or your violation of any law or third-party right.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be indicated by updating the date above, and continued use of the Service after changes take effect constitutes acceptance. If you do not agree to updated Terms, stop using the Service.
